Terms of Service

1. Who we are

Niwaas is a product of WebAayam ("WebAayam", "we", "us", "our"), operating from Mansarovar, Jaipur, Rajasthan, India. These Terms of Service ("Terms") govern the purchase and use of the Niwaas service, and apply to every client ("you", "your") who purchases a plan through this website.

2. What we sell

We build and publish a white-labelled hotel booking mobile app, branded to your hotel, and we host the backend that powers it. Two plans are available, described in full on our Pricing page:

• One-Time — a one-time build fee, hosting included through month 12, then a required annual renewal from month 13 onward to keep the app live.
• Subscription — a setup fee followed by a recurring monthly or annual fee, which includes hosting and support for as long as the subscription stays active.

3. Payment structure

50% of the order total is due upfront before we begin work. The remaining 50% — plus the cost of any add-ons — is due before the finished app is published and handed over. For the Subscription plan, this 50/50 split applies only to the one-time setup fee; the recurring monthly or annual fee is billed separately once the app is live.

All payments are non-refundable once paid, including the initial 50% deposit. This is because work begins as soon as the deposit clears. Full detail is in our Refund & Cancellation Policy, which forms part of these Terms.

4. Support

Both plans include hosting and support through month 12 (One-Time clients also receive one month of active setup help and bug fixes starting from the date the app is published). From month 13 onward, continued hosting requires one of the renewal options described on our Pricing page — Hosting Only or Hosting + Support, billed monthly or annually. Support beyond bug-level maintenance is only included under the Hosting + Support option.

5. Renewal and non-payment

If a required renewal payment is not made — from month 13 onward for either plan, or a Subscription plan's monthly/annual billing before then — we may suspend or take the app offline until payment is received. We are not responsible for any business impact resulting from a lapsed renewal or subscription.

6. Add-ons

Publishing to your own Google Play Console is available as a paid add-on. Because this depends on Google's own account verification process, we cannot guarantee a fixed timeline for this add-on. iOS publishing is not available at this time.

7. Client responsibilities

You are responsible for providing accurate hotel and room information, branding assets, and for holding a valid Razorpay or PayU merchant account to receive guest payments through your app. We are not a party to, and hold no responsibility for, payments processed between you and your guests through your chosen payment gateway.

8. Limitation of liability

To the fullest extent permitted by law, WebAayam's total liability arising from these Terms is limited to the amount you have paid us in the twelve months preceding the claim.

9. Governing law

These Terms are governed by the laws of India, and any dispute is subject to the exclusive jurisdiction of the courts of Jaipur, Rajasthan.
